Acceptable Use Policy

OfferLab.com ("OfferLab") was created to help entrepreneurs, affiliates, and small businesses launch, promote, and scale their products and services through the most effective online marketplace possible. Our mission is to provide an exceptional platform experience while maintaining a safe, trustworthy, and compliant community.
We take pride in maintaining a platform that demonstrates respect, tolerance, and acceptance for each and every User on the OfferLab platform. To that effect, we have set forth stringent guidelines and requirements through this Acceptable Use Policy ("AUP") to set clear guidelines for proper conduct, protect our Users, and reduce abuse and spam.
1. Using OfferLab
1.1.Definitions. "Platform" means the entire OfferLab service, including its websites, tools, marketplaces, products, and any current or future features or offerings, all of which are subject to this AUP.
"User" means any customer, seller, affiliate, or subscriber using OfferLab. We use this term interchangeably with "You" throughout this policy.
1.2.Your responsibility. All Users are responsible for their account activity and adherence to this AUP while using the Platform. Your use of OfferLab is governed by these guidelines, our Terms of Service, and applicable local, national, and international laws.
You are ultimately accountable for the content You post, the products You list, and the communications You send while using the Platform.
To maintain a safe, trustworthy, and legally compliant marketplace, all Users must adhere to the guidelines set forth herein. Violations may result in warnings, content removal, temporary suspensions, or permanent removal from the OfferLab platform.
2. User conduct and restrictions
2.1.Harmful or prohibited acts. Any dishonest or unethical business practice; any violation of the law; infliction of harm to OfferLab's reputation is prohibited. Users may not engage in hacking or other digital or physical attacks on the Website; scraping, crawling, downloading, screen-grabbing, or otherwise copying content on the Website and/or transmitting it in any way we haven't specifically permitted; introducing, transmitting, or storing viruses or other malicious code; interfering with the security or operation of the Website; framing or mirroring the Website; creating, benchmarking, or gathering intelligence for a competitive offering; infringing another party's intellectual property rights, including failing to obtain permission to upload/transfer/display works of authorship; intercepting or expropriating data; deceptive manipulation of media; and the violation of the rights of OfferLab or any third-party.
2.2."Spamming" and unsolicited communications. We have zero tolerance for spam and unsolicited communications. Any communications sent or authorized by You reasonably deemed "spamming," or any other unsolicited solicitations (including without limitation postings on social media or third party blogs) will be deemed a material threat to OfferLab's reputation and to the rights of third parties. It is Your obligation, exclusively, to ensure that all business communications comply with state and local anti-spamming or analogous laws.
2.3.Offensive communications. You may not use the Platform to create, transmit, post, or authorize any communication, including but not limited to content on websites operated by the You, social media, or blogs, that is sexually explicit, obscene, vulgar, or pornographic; offensive, profane, hateful, threatening, harmful, inciting, defamatory, libelous, harassing, or discriminatory; misleading, false, or misinforming; graphically violent; or solicitous of unlawful behavior.
2.4.Personal, confidential, and protected health information. You may not post or upload any materials that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, social security numbers, bank account numbers, confidential national ID numbers, or account passwords unless You have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent. You may not use the Platform to collect, store, or process any protected health information subject to the Health Insurance Portability and Accountability Act ("HIPAA"), any applicable health privacy regulation or any other applicable law governing the processing, use, or disclosure of protected health information.
2.5.Illegal business activity. You may not use the Platform to promote any illegal business activity, including without limitation multi-level marketing (except in compliance with the FTC's Business Guidance Concerning Multi-Level Marketing), promoting the sale or use of illegal drugs, or infringing or promoting the infringement of the intellectual property rights of another. You may not offer, promote, or post goods or services that contravene or that facilitate or promote activities that contravene, the laws of the jurisdictions in which You operate or do business, or that are otherwise applicable to You and/or OfferLab.
2.6.Prohibited products and services. You may not use the Platform to advertise, market, sell or distribute products or services that are unlawful, unsafe, misleading, or otherwise inconsistent with the standards of OfferLab.
Prohibited categories include the following: weapons, firearms, ammunition, explosives, or destructive components; hazardous materials or items that are recalled, defective, or unsafe for consumer use; alcoholic beverages, tobacco products, vaping products, or gambling services where such activities require age verification or are otherwise restricted by law; pornography, sexually explicit material; counterfeit, pirated, or infringing goods; prescription drugs, controlled substances, FDA-banned products, or any items marketed with unsubstantiated health or disease-related claims; and products or materials whose sale, distribution, or possession is restricted or prohibited under applicable law. OfferLab reserves the right, in its sole discretion, to determine whether a product or service falls within these categories and to suspend or terminate accounts engaged in such activity.
Additionally, You must abide by the Prohibited and Restricted Businesses terms published by Stripe, Inc.
2.7.Promotional practices. You are prohibited from engaging in any promotional activity on the Platform that is false, misleading, deceptive, or otherwise non-compliant with applicable laws and regulations, including but not limited to the Federal Trade Commission's guidelines. This includes making unsubstantiated claims, presenting false or fabricated testimonials, exaggerating product or service benefits, or misrepresenting health, financial, or other outcomes. You may not attempt to circumvent OfferLab's payment or tracking systems, redirect or divert customers away from the Platform in a misleading manner, or otherwise manipulate affiliate links or referral mechanisms. OfferLab reserves the right to determine, in its sole discretion, whether any promotional activity violates this policy and to take such remedial actions as it deems appropriate.
2.8.PCI DSS compliance. All activities by Platform Users shall be conducted in compliance with Payment Card Industry Data Security Standard requirements. This includes all uploads, communications, and handling and storage of credit card data.
3. Violations and enforcement
3.1.Three strikes policy. OfferLab maintains a three strikes policy to give Users an opportunity to address violations of this AUP:
- First Violation: A written warning will be issued with instructions for corrective actions.
- Second Violation: The User's account may be temporarily suspended until all remedial steps are taken to OfferLab's satisfaction.
- Third Violation: The User's account may be permanently terminated, with loss of access to the Platform and associated data.
OfferLab reserves the right to bypass the three strikes policy and immediately suspend or terminate an account, in its sole discretion, without warning, and without incurring any obligation or liability to You.
3.2.Reporting violations. Users who become aware of any activity or content on the Platform that may constitute a violation of this AUP are encouraged to report such violations to compliance@offerlab.com. Reports should include relevant details, including URLs, screenshots, or other supporting information to assist OfferLab in investigating the matter. Submission of a report does not create any obligation to take action or provide a specific remedy on the part of OfferLab beyond its discretion to review and address the reported conduct.
3.3.Enforcement. OfferLab reserves the right, in its sole discretion, to investigate any actual or suspected violation of this AUP and to take such actions as it deems appropriate, including but not limited to issuing warnings, requiring corrective actions, suspending or terminating accounts, removing content, and referring matters to law enforcement or other authorities. Enforcement decisions, including decisions regarding the severity of any violation and the appropriate remedial action, are final and binding.
